1. ACCEPTANCE OF TERMS By downloading, installing, and using the ColorMatch Pro mobile application ("Application"), you agree to comply with and be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Application. 

2. LICENSE AND RESTRICTIONS 

### 2.1 License Grant ColorMatch Pro grants you a limited, non-exclusive, non-transferable, revocable license to use this Application for personal, non-commercial purposes only. 

### 2.2 Restrictions You agree NOT to: - Reverse engineer, decompile, or modify the Application - Distribute, rent, lease, or lend the Application - Use the Application for any commercial purpose - Remove any proprietary notices or labels - Attempt to derive the source code 

3. INTELLECTUAL PROPERTY RIGHTS All content in this Application, including but not limited to software, designs, algorithms, and text, is the intellectual property of ColorMatch Pro and is protected by international copyright laws. The color-matching algorithms, LAB color space calculations, and Delta-E 2000 formulas are proprietary technology owned by ColorMatch Pro. 

4. USER RESPONSIBILITIES

### 4.1 Accuracy Disclaimer While ColorMatch Pro uses scientific color-matching technology (LAB color space, Delta-E 2000), we cannot guarantee 100% accuracy in paint color matching due to: - Variations in device cameras - Different lighting conditions - Paint pigment variations between brands - Screen display calibration differences Users should verify color accuracy before purchasing paint.

### 4.2 User-Generated Content Any images you upload to ColorMatch Pro are processed locally on your device and are NOT stored on our servers (unless you opt for cloud sync). We do not claim ownership of your images. ### 4.3 Professional Advice This Application is a tool, not professional art advice. Users are responsible for their own artistic decisions. 

5. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORMATCH PRO IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ColorMatch Pro SHALL NOT BE LIABLE FOR: - Damages from color mismatches - Loss of data or images - Interrupted service - Bugs or errors in the Application - Indirect, incidental, or consequential damages 

6. DISCLAIMER OF WARRANTIES 

### 6.1 No Warranty ColorMatch Pro disclaims all warranties, express or implied, including merchantability, fitness for particular purpose, and non-infringement. 

### 6.2 Color Accuracy While we use industry-standard color science (LAB color space, Delta-E 2000 formulas based on Kubelka-Munk theory), we do NOT guarantee perfect paint color matching. Variables such as: - Camera calibration - Lighting conditions - Screen color accuracy - Paint brand differences ...may affect results. 

7. INDEMNIFICATION You agree to indemnify and hold harmless ColorMatch Pro from any claims, damages, or costs arising from your use of this Application or violation of these Terms. 

8. MODIFICATIONS TO SERVICE ColorMatch Pro reserves the right to: - Modify or discontinue the Application - Update features, algorithms, or functionality - Change these Terms of Use with 30 days' notice 

9. TERMINATION ColorMatch Pro may terminate your access if you violate these Terms. Upon termination: - Your license to use the Application immediately ends - You must delete all copies from your devices 

10. ACCESSIBILITY ColorMatch Pro is designed with accessibility as a core feature, specifically for users with color blindness (Deuteranopia, Protanopia, Tritanopia). Features include: - High contrast interface - Clear text labels - Patterns in addition to colors - Works offline - No subscription required 

11. THIRD-PARTY SERVICES This Application may use third-party libraries and services for camera access, device storage, and image processing. These are governed by their respective licenses. 

12. GOVERNING LAW These Terms are governed by the laws of [Your Country/State], without regard to conflict of law principles. 

13. DISPUTE RESOLUTION ### 13.1 Arbitration Any dispute arising from these Terms shall be resolved through binding arbitration, not litigation. 

### 13.2 Small Claims Either party may bring claims in small claims court instead of arbitration.
